These Terms of Service (“Terms”) govern your access to and use of the Caring Village platform operated by Caring Village, LLC (“Caring Village,” “we,” “us,” or “our”).
The Caring Village platform includes the Caring Village website, web application, mobile applications available through the Apple App Store and Google Play, and any related services, features, content, or functionality (collectively, the “Platform”).
By accessing or using the Platform, you agree to these Terms. If you do not agree, you may not use the Platform.
1. Platform License
Subject to your compliance with these Terms, Caring Village grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal caregiving coordination and informational purposes.
You agree not to:
- reverse engineer, decompile, or attempt to extract source code
- reproduce, copy, distribute, or create derivative works
- use the Platform for unlawful purposes
- attempt to disrupt the Platform’s operation or security
We may update, modify, or discontinue the Platform at any time.
2. Account Registration
Certain features require creating an account.
You agree that:
- all information you provide is accurate and current
- you are responsible for safeguarding your login credentials
- you are responsible for all activity under your account
You must be at least 18 years old to use the Platform.
3. Privacy
Your use of the Platform is subject to our Privacy Policy, which describes how we collect and use information.
4. User Content
The Platform allows users to create and share content including caregiving notes, wellness journal entries, tasks, photos, and other information (“User Content”).
You retain ownership of your User Content.
By submitting content to the Platform, you grant Caring Village a non-exclusive, worldwide, royalty-free license to:
- host
- store
- display
- transmit
- process
such content solely for the purpose of operating and improving the Platform.
You represent that you have the rights necessary to submit this content.
5. Medical Disclaimer
The Platform is intended for personal care coordination and informational purposes only.
Caring Village does not provide medical advice, diagnosis, or treatment. Information available through the Platform should not be used as a substitute for professional medical advice.
Always consult qualified healthcare professionals regarding medical conditions or treatment decisions.
6. Caregiving Responsibility
The Platform provides tools to help families organize caregiving information and coordinate care activities.
All caregiving decisions, medical decisions, medication administration, and safety-related actions remain the sole responsibility of users and their care teams.
Caring Village does not assume responsibility for care outcomes or the well-being of individuals receiving care.
7. Information About Others
Users may enter and share information about individuals receiving care.
By submitting such information, you represent that you have the authority and consent necessary to provide and share that information with authorized members of your village or care group.
Users are responsible for ensuring that any shared information complies with applicable privacy laws.
8. Artificial Intelligence and Automated Insights
Certain features of the Platform may provide insights or recommendations using artificial intelligence or automated technologies.
These outputs are generated based on available data and algorithms and may not always be accurate or complete.
Automated insights are provided for informational purposes only and should not be relied upon as professional advice.
9. Not for Emergency Use
The Platform is not designed for emergency or time-critical medical situations.
Users should not rely on the Platform for urgent medical needs. In the event of a medical emergency, contact appropriate emergency services immediately.
Caring Village is not responsible for delays or interruptions in the Platform that may impact caregiving activities.
10. HIPAA and Health Information
Caring Village is not a healthcare provider, health plan, or healthcare clearinghouse and is not acting as a “covered entity” or “business associate” under the Health Insurance Portability and Accountability Act (“HIPAA”), unless explicitly agreed to in writing.
Health-related information stored within the Platform is voluntarily entered by users and may not be subject to the same protections as medical records maintained by healthcare providers.
11. Payments and Subscriptions
Certain features may require payment of subscription fees.
Subscriptions automatically renew unless canceled before the renewal date.
Payments may be processed through third-party providers including:
- in-app purchase providers
- payment processors
Refund policies may vary depending on the purchase method.
12. Third-Party Services
The Platform may include links to or integrations with third-party services.
Caring Village is not responsible for the availability, content, or policies of these services.
13. Warranty Disclaimer
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
We do not guarantee uninterrupted or error-free operation.
14. Limitation of Liability
To the maximum extent permitted by law, Caring Village’s total liability for any claims arising from the use of the Platform will not exceed the amount paid by the user to Caring Village during the preceding 12 months.
15. Indemnification
You agree to indemnify and hold harmless Caring Village from claims resulting from:
- your use of the Platform
- violation of these Terms
- violation of third-party rights
16. International Use
The Platform may be accessed worldwide. Users are responsible for complying with applicable laws in their jurisdiction.
17. Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
18. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia.
